§ 96.99 PENALTY.
   (A)    In any prosecution for a violation of this chapter the court may admit evidence of a noise level as tested by a sound level meter which meets or exceeds the American National Standards Institute (ANSI) specifications for Type II equipment. A person shall be found to have violated this chapter for the emission of excessive noise from or on any motor vehicle source in excess of the limitations established herein.
   (B)   Any person violating any provisions of this chapter may be issued a citation for a violation of this noise control chapter. Whenever any law enforcement officer issues a citation for violation of this chapter, he or she shall take down the name, address, operator's license number, and registration number of the vehicle if readily available and shall issue to the alleged violator in writing on the form provided by the town, a citation for a violation of this chapter. A person who violates this chapter shall be subject to a penalty of $50 for the first offense, $100 for the second offense, and $350 for the third or subsequent offenses.
   (C)   In addition to the monetary penalties provided in division (B) above, a court, upon application of the town, may enter injunctive relief to prevent future violations for maintaining a nuisance.
