§ 110.99 PENALTY.
   (A)   It shall be unlawful for any transient merchant to sell or offer to sell any goods, wares, merchandise or services within the corporate limits of the Town of Chandler, Indiana, without having first obtained a license to do so.
   (B)   Any person who acts as a transient merchant within the corporate limits of the Town of Chandler, Indiana without having first obtained a license to do so, or who violates any other provision of § 110.01, shall pay penalty of $250 for the first such violation; $500 for a second violation within any 1 calendar year; and $2,500 for any third or subsequent violations within any 1 calendar year. Each day in which a violation occurs shall be deemed to constitute a separate offense.
   (C)   All penalties shall be payable to the Town of Chandler Clerk-Treasurer. The Town of Chandler Clerk-Treasurer is the Town of Chandler Violations Clerk and shall receive all payment of penalties under this chapter for which the violator desires to waive trial and admit the violation. All cases wherein persons cited for a violation do not waive trial and admit the violation or default in appearance before the Town of Chandler Clerk-Treasurer shall be referred to the Town Attorney for filing with the appropriate court in Warrick County, Indiana.
