(A) General. Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
(B) (1) Prohibitions.
(a) No owner of real property within the Town of Chandler shall be allowed any growth of weeds in excess of 8 inches in height upon his or her property.
(b) No owner of real property shall allow the growth of rank vegetation upon his or her property.
(2) Violations. It shall be a violation of this chapter for any person to fail to comply with division (B)(1) above. Any penalty for the violation herein shall be in addition to any costs and expenses incurred in the removal of the violation by the Town of Chandler, its agents, employees and/or contractors.
(3) Penalty.
(a) Any person who violates division (B)(1) above shall be subject to a penalty of not more than $50 for the first violation in any 12-month period for each violation.
(b) Any person who violates division (B)(1) above a second time in any 12-month period shall be subject to a penalty of not less than $100 for each violation.
(c) Any person who violates division (B)(1) above for a third or subsequent occasion in any 12-month period shall be subject to a penalty of not more than $500.
(d) The Clerk-Treasurer of the Town of Chandler is hereby authorized to accept the payment of the monetary penalties into the general fund of the town.
