§ 51.37 DELINQUENT USERS; NOTICE AND HEARING.
   (A)   Pursuant to I.C. 8-1.5-3-4(d), customers of the town’s sewage works whose sewer rates and charges, or any part thereof, remain unpaid for 30 days or longer shall be considered DELINQUENT SEWAGE WORKS CUSTOMERS, and be subject to discontinuation of their water service.
   (B)   Pursuant to I.C. 8-1.5-3-4(e), the Town Council hereby designates the town’s wastewater utility to, before water service is discontinued under this section, give written notice to the water consumer or property owner of its intention to discontinue water service if the unpaid wastewater service charges are not paid before the date specified in the notice. The notice must be mailed not less than 14 days before water service is to be discontinued and addressed to the water consumer or the property owner at his or her last known address.
   (C)   Any dispute of the billed services must be presented by the customer to the Town Utility Board within ten days of receiving the billing statement. The Utility Board can and may modify any utility payment as it sees fit. Change of utility document must be filled out and submitted to the Utility Clerk and/or Town Clerk-Treasurer, if there is no Utility Clerk prior to Utility Board meeting. Said dispute must be received prior to the disconnection of the customer’s utilities.
   (D)   The Town Council, or its duly appointed and authorized hearing officer, will consider challenges by delinquent sewage work’s customers, of the disconnection of their water service for non-payment of sewer rates and charges, by applying criteria adopted by the Town Council, from time to time, to the unique facts and circumstances presented by each customer and shall be authorized to cancel or postpone orders to disconnect water service.
