A. Any parent, legal guardian or other adult person violating the provisions of Section 5-4-2 of this Chapter shall be guilty of a misdemeanor, and shall upon conviction for the first offense be subject to a fine not to exceed one hundred dollars ($100.00), and upon a second offense or subsequent conviction be subject to community service not to exceed one hundred sixty (160) hours or a fine not exceeding three hundred dollars ($300.00), or both.
B. Any person violating the provisions of Section 5-4-1 of this Chapter who is seventeen (17) years or younger shall be subject to the provisions of the Juvenile Correction Act, Idaho Code title 20, sections 501–547, and shall be detained or otherwise dealt with pursuant to that Act.
