A. Application For Hearing: All persons desiring consideration for a special request should file an application with the city and ask to be placed on the agenda of the next regularly scheduled meeting of the planning and zoning commission 1 .
B. Request Review: Within ten (10) days of its regularly scheduled meeting, the planning and zoning commission shall review the request for conformance or nonconformance to regulations.
C. Responsibilities Of Applicant: If the application is within the limits of the applicable regulations, the commission shall set a date for a public hearing. Applicant shall be responsible for:
1. Notifying adjacent property owners; procedures are stated in section 9-5-2-2 of this chapter.
2. Getting notification of public hearing date, time, location and topic of discussion in the newspaper; procedures are stated in section 9-5-2-2 of this chapter.
3. Securing an affidavit of proof of notification from the newspaper.
4. Obtaining all other pertinent information as stated in the application.
D. Planning And Zoning Commission Action: Within ten (10) days of the hearing, the commission shall approve, conditionally approve or disapprove the request and forward a recommendation to the city council. Requests shall automatically be placed on the agenda of the next regularly scheduled meeting of the city council.
E. City Council Action: The council shall review commission recommendations and set a date for a public hearing where applicable.
F. Additional Responsibilities Of Applicant: Applicant shall again be responsible for items stated in subsections C1 through C4 of this section.
G. Final Decisions: Within fifteen (15) days of the public hearing, the commission shall approve, conditionally approve or disapprove the request. (Ord. 499, 4-16-2009)
