ORDINANCE NO. 661-2020
AN ORDINANCE AMENDING PROCEDURES FOR REFUNDS OF SECURITY DEPOSITS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF CERRO GORDO, PIATT COUNTY, ILLINOIS AS FOLLOWS:
WHEREAS, the Board of Trustees of the Village of Cerro Gordo has authority to establish regulations and fees related to connection to and disconnection from the water and sewer systems of the Village of Cerro Gordo; and
WHEREAS, the Board of Trustees of the Village of Cerro Gordo believes it is in the best interests of the Village that those permanently disconnecting from the water and sewer systems of the Village of Cerro Gordo pay their bill in full prior to return of the deposit, subject to the other ordinances of the Village of Cerro Gordo.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF CERRO GORDO, ILLINOIS, AS FOLLOWS:
Section 1: Title 9, Chapter 1, Section 5 of the Code of Ordinances of the Village of Cerro Gordo, Piatt County, Illinois, shall be further amended as follows:
9-1-5. WATER SERVICE PERMIT AND DEPOSIT REQUIREMENTS:
C. Deposit Required:
A deposit of fifty dollars ($50.00) for applicants who are owners of record of the property receiving the water service shall be made with each application provided in this section, which sum shall be retained by the Village to ensure the payment of all bills. If the applicant is a nonowner occupant, renter, tenant or lessee of the property receiving the water service, said nonowner applicant shall pay a deposit of one hundred dollars ($100.00), which sum shall be retained by the Village to ensure the payment of all bills.
When service to the applicant is discontinued permanently, the deposit, less anythe amount still due the Village for water service shall be paid in full by the applicant. Upon payment in full, the deposit shall be returned, without interest, upon request of the person or persons entitled thereto. If no request is made within one year after said permanent discontinuation, said monies shall become Village property and shall be deposited into the Water Fund of the Village.
Section 2: Except as modified above, the remaining provisions of Title 9 shall remain in full force and effect as originally passed and thereafter amended.
Section 3: Any other ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 4: This ordinance shall become effective immediately upon its passage.
Section 5: The Village Clerk is instructed to insert this Ordinance in its designated place in the copy of the Code of Ordinances of the Village of Cerro Gordo, Piatt County, Illinois, kept on file in the Office of the Village Clerk to reflect the intention of the President and Board of Trustees to make this Ordinance a part of said Code.
This ordinance was presented, approved and passed on this 17 day of August, 2020, by “aye” and “nay” votes at which time the Trustees voted 5 “aye” votes and 0 “nay” votes therefore the Ordinance Number 661-2020 is to be effective immediately.
