8-2-12: PLANTING VEGETATION ON PUBLIC PROPERTY:
   A.   Permit Required: No trees, bushes, shrubs or any plants whatsoever, except grass and flowers, shall be planted on any boulevard or property belonging to the village without the permission of the village board. The permission required herein must be given by a majority of trustees present at any regular or special meeting of the village board at which a quorum is present. (1995 Code § 5.120)
   B.   Penalties:
      1.   Any person violating any of the provisions of this section shall be subject to a fine as provided in section 1-4-1 of this code for each offense. (1995 Code § 5.120; amd. 2012 Code)
      2.   In addition to any fine which may be levied, the person doing said planting shall remove said plants and return the ground to the same condition as prior to said planting. In the event of refusal to remove, the village shall have the right to remove said planting and return the ground to the same condition as prior to said planting and shall have the right to bring action against the person doing said planting for the reasonable cost of removing said planting and returning the ground to said condition and for any attorney fees and costs incurred in bringing the action.
