(A) Policy. Different degrees of force are sometimes justified, depending on the facts pertaining to the situation. Therefore, in each individual situation, lawful and proper force is only that force necessary to control and stop unlawful resistance and to ensure that there will be no further physical attack against police officers or any other person.
(B) Procedure.
(1) Whenever an officer of the Police Department discharges a weapon at another person or persons, he or she shall immediately notify the Chief of Police or, if he or she is not available, the next officer in the chain of command. The Chief of Police shall immediately notify the Town Attorney. Further, the firearms and tactics instructor will also be notified directly after the Chief of Police or other command officer. These notifications apply whether the shooting officer is on or off duty at the time of the incident, and whether or not the incident takes place in or out of the town. All incidents of officers shooting at a person or persons will be investigated by the agency or agencies designated by the Chief of Police.
(2) Whenever an officer shoots at other than a person or persons, whether intentionally or accidentally, the officer will file a written report with the Chief or other command officer. This report will contain all of the facts relating to the shooting incident.
