§ 33.080  SHOOTING AT OR FROM VEHICLE.
   (A)   Shooting at vehicles.
      (1)   Policy. Different degrees of force are sometimes justified, depending on the facts pertaining to the situation. Therefore, in each individual situation, lawful and proper force is only that force necessary to control and stop unlawful resistance and to ensure that there will be no further physical attack against police officers or any other person.
      (2)   Rule. Officers will not shoot at moving vehicles, except in self-defense, the defense of another police officer or of a third party.
   (B)   Shooting from moving vehicles. Different degrees of force are sometimes justified, depending on the facts pertaining to the situation. Therefore, in each individual situation, lawful and proper force is only that force necessary to control and stop unlawful resistance and to ensure that there will be no further physical attack against police officers or any other person.
