§ 33.079  SHOOTING AT FLEEING MISDEMEANANTS.
   (A)    Policy. Different degrees of force are sometimes justified, depending on the facts pertaining to the situation. Therefore, in each individual situation, lawful and proper force is only that force necessary to control and stop unlawful resistance and to insure that there will be no further physical attack against police officers or any other person.
   (B)    Rule. Officers will not intentionally use deadly force to effect the arrest of a minor misdemeanant, misdemeanant or traffic violator.
