(A) Purpose. The purpose of this subchapter is to establish guidelines concerning the operation of police vehicles during normal, emergency and pursuit conditions; and procedures related to police vehicle accidents and damage.
(B) Policy.
(1) It is the policy of the town’s Police Department that all officers operate town-owned vehicles with due regard for the safety of all persons. Officers are reminded that state and local provisions will not protect an officer from the consequences of reckless disregard for the safety of others.
(2) The traffic law exemptions permitted under I.C. 9-21-1-8 are only allowable when the emergency vehicle is making use of audible or visual signals while responding to an emergency or when in pursuit of an actual or suspected violator of the law. Therefore, officers shall obey all lawful traffic regulations while on routine patrol.
