§ 33.021  DISCHARGE OF FIREARMS.
   (A)   No officer shall discharge a firearm in connection with police duty, except under the following circumstances:
      (1)   At an approved range;
      (2)   Killing animals that are wounded, injured or dangerous when other disposition is impractical;
      (3)   When authorized by the Town Marshal or a ranking officer;
      (4)   In the defense of his or her own life;
      (5)   In the defense of the life of another person; and
      (6)   To effect the capture or prevent the escape of a person whom the officer has reasonable cause to believe has committed a heinous crime such as murder, rape or armed robbery.
   (B)   If an officer discharges his or her gun accidently or intentionally in the performance of police duty, he or she shall notify the Marshal verbally at the earliest opportunity and shall file a written report of the incident. Violation of this provision shall be considered conduct injurious to the public welfare or public peace.
