§ 33.019  AVAILABILITY ON PATROL.
   (A)   Officers assigned to motor patrol shall maintain radio contact with the base station at all times. During temporary absences from the patrol car, they shall notify the base station of their location and method of contact. When stopping out-of-county cars or during emergencies, they shall notify the base station of their location, and the make, model, color and license number of the car.
   (B)   (1)   Officers of the Police Department shall not drink intoxicating liquors of any kind while on duty or while off duty to an extent unfitting him or her for duty. The odor of liquor on the breath of an officer when reporting shall be deemed sufficient evidence that he or she is unfit for duty, or while on active duty, shall not be fit for duty and in violation of this section.
      (2)   In the event of special investigation or undercover work, this provision may be waived by the Town Marshal to the extent that drinking intoxicating liquor may be permitted, but never to the extent of intoxication in the assignment.
      (3)   Violation of this section shall be considered as immoral conduct.
