For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
PRIVATE SWIMMING POOLS. Any swimming pool or wading pool over 24 inches in depth or with a surface area exceeding 250 square feet, in conjunction with a private residence, intended for the use of the individual owner, his or her family and friends, including pools constructed of any materials, either permanent or temporary, and either above or below ground or partly above and partly below ground.
