(A) No trees shall be planted between the street curb and sidewalk in any street right-of-way where the width of the space is less than six feet, without first obtaining the approval of the Council as to the planting and the type of tree to be planted. Trees shall not be planted along any sidewalk in a street right-of- way less than 30 feet apart or as directed by the Council.
(B) Maintenance of any tree planted between the curb and sidewalk in any street right-of-way is the responsibility of the adjacent property owner unless the tree directly interferes with power lines. If any tree is in contact with the power lines, the town shall be responsible for trimming and removing the limbs that contact the lines and thereafter the property owner shall be responsible for any further maintenance of the tree.
