§ 92.99  PENALTY.
   (A)   Any person, firm or corporation who violates any provision of this chapter, or fails,  neglects  or refuses to comply with any order issued pursuant to this chapter, shall, on conviction thereof, be fined $25 for each violation. Each day a violation continues shall constitute a separate offense.
   (B)   An owner who violates this chapter commits a Class A infraction. An owner commits a Class D felony subject to prosecution under state law, if:
      (1)   He or she knowingly or intentionally violates § 92.03(A) of this chapter; and
      (2)  Bodily injury (as defined in I.C. 35-31.5-2-29) or loss of life occurs as a result of a fire in the building.
   (C)   A person who violates § 92.03(B) of this chapter commits a Class A infraction.
