§ 90.04  REMOVAL, DISPOSAL OF ABANDONED VEHICLES.
   (A)   The Town Marshal is the authorized agency assigned the responsibility for removing vehicles defined as “abandoned” under the provisions of I.C. 9-13-2-1.
   (B)   Any vehicle which, under the standards established by I.C. 9-22-1-23, has a value of less than $100 shall be subject to removal to an automobile scrapyard, where the vehicle shall be disposed of in such a fashion so as to render it incapable of use as a vehicle. The vehicles shall be tagged by a police officer with a notice tag affixed in a prominent place on the vehicle. The tag shall contain the following information:
      (1)   The date, time, officer’s name and the address and telephone number to contact for information;
      (2)   The vehicle or parts are considered abandoned;
      (3)   The vehicle or parts will be removed after 72 hours;
      (4)   The owner will be held responsible for all costs incidental to the removal, storage and disposal and, if not paid, the owner’s registration privileges will be suspended on that car; and
      (5)   The owner may avoid costs by removal of the vehicle or parts within 72 hours.
   (C)   Vehicles valued in excess of $100 according to the standards set forth in I.C. 9-22-1-23 and found abandoned shall be tagged with a notice tag by a police officer. The notice shall contain the following information:
      (1)   The date, time, officer’s name and address and telephone number to contact for information;
      (2)   The vehicle or parts are considered abandoned;
      (3)   The vehicle or parts will be removed after 72 hours;
      (4)   The owner will be held responsible for all costs incidental to the removal, storage and disposal and if not paid the owner’s registration privileges will be suspended on that car; and
      (5)   The owner may avoid costs by removal of the vehicle or parts within 72 hours.
   (D)   If the tagged vehicle or parts are not removed within that 72-hour period, the officer shall prepare a written abandoned vehicle report of the vehicle or parts including information on the condition, missing parts, and other facts that might substantiate that the market value is less than $100. Photographs shall be taken to describe the condition of the vehicle or parts.
   (E)   The final disposal of vehicles valued at either over $100 or under $100 shall be in accordance with the provisions of I.C. 9-22-1-1 et seq., which is incorporated by reference as if fully set forth herein.
