§ 50.13 BURNING OF DRIED LEAVES.
   (A)   The burning of dried leaves on private property is allowed with a permit from the city under the following conditions:
      (1)   The burning of leaves will only be permitted from October 1 through December 1.
      (2)   A responsible person shall be in constant attendance until the fire is completely extinguished. A garden hose, hooked to the water supply shall be available.
      (3)   (a)   When the ground is snow covered, burning is allowed between the hours of 10:00 a.m. and 8:00 p.m. All fires shall be extinguished by 8:00 p.m.
         (b)   When the ground is not snow covered, burning is allowed between the hours of 6:00 p.m. and 8:00 a.m., of the following days, in a burner of a design approved by the Commissioner of the DNR, if thee is not combustible material within 5 feet of the base of the burner.

      (4)   The fires shall not be less than 25 feet from any structure, wood fence, hedge or bush and no less than 5 feet from any property line.
      (5)   The burning of leaves is prohibited on city streets, boulevards, lake shore or any public property by private citizens.
      (6)   No open burning of leaves shall take place during a fire danger alert declared by the Fire Chief of Center City or the Minnesota Department of Natural Resources.
   (B)   This section pertains to only the burning of leaves. Any burning of rubbish, trash or other material is prohibited.
