For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ATTORNEY. The attorney or legal firm appointed or engaged by the City Council to represent the city on questions arising under this chapter.
BLOCK. The enclosed area within the perimeter of roads, property lines, or boundaries of the subdivision.
BOULEVARD. The portion of the street right-of-way between the curb line and property line.
BUILDING OFFICIAL. That person or persons authorized by the City Council to administer the State Building Code, the Zoning Ordinance, and the Subdivision Regulations.
BUTT LOT. A lot at the end of a block and located between 2 corner lots.
CLUSTER DEVELOPMENT. A subdivision development planned and constructed so as to group housing units into relatively tight patterns while providing a unified network of open space and wooded areas, and meeting the overall density regulations of this chapter and the Zoning Regulations.
COLLECTOR STREET. A street which carries traffic from minor streets to thoroughfares or from thoroughfare to thoroughfare. It includes the principal entrance streets of a residential development and for circulation within such a development.
COMPREHENSIVE DEVELOPMENT PLAN. The plan or plans for the orderly growth of the city and adopted and amended from time to time by the Planning Commission and the City Council.
COUNCIL. City Council.
COUNTY. Chisago County, Minnesota
CUL-DE-SAC. A minor street with only 1 outlet and having a turnaround.
DRAINAGE COURSE. A water course or indenture for the drainage of surface water.
EASEMENT. A grant by an owner of land for the specific use by persons other than the owner or the public.
ENGINEER. City Engineer.
FINAL PLAT. The final map, drawing or chart on which the subdivider’s plan of subdivision which will be submitted to the County Register of Deeds or Register of Titles. The plan must conform to all state laws.
GROUP HOUSING. A housing project consisting of a group of 5 or more buildings constructed on a plot of ground 3 acres or more in size.
LOT. A single tract, within a subdivision marked as a numbered tract to be offered as a unit of land for sale, lease, or separate use thereof.
LOT WIDTH. The dimension of a lot measured at the building setback line as established by zoning regulations.
MINIMUM SUBDIVISION DESIGN STANDARDS. The guides, principles and specifications for the preparation of subdivision plans indicating among other things, the minimum and maximum dimensions of the various elements set forth in the preliminary plan.
MINOR STREET. A street of limited continuity used primarily for access, to the abutting properties and the local needs of a neighborhood.
OWNER. An individual, firm, association, syndicate, co-partnership, corporation, trust, or any other legal entity having sufficient proprietary interest in the land sought to “be subdivided” to commence and maintain proceedings to subdivide the same under these regulations.
PERSON. Any individual, firm, association, syndicate or partnership, corporation, trust, or any other legal entity.
PLANNING COMMISSION. The Planning Commission of the city.
PRELIMINARY PLAN. The preliminary plat map, drawing or chart indicating the proposed layout of the subdivision to be submitted to the Planning Commission and the City Council for their consideration, as compliance with the Comprehensive Development Plan and these regulations along with required supporting data.
PRIVATE STREET. A privately owned street.
PROTECTIVE COVENANTS. Contracts entered into between private parties and constituting a restriction on the use of private property within a subdivision for the benefit of the property owners to provide mutual protection against undesirable aspects of development which would tend to impair stability of values.
SERVICE STREET. Marginal access street, or otherwise designated, is a minor street which is parallel and adjacent to a thoroughfare and which provides access to abutting properties and protection from through traffic.
STREET. A public way for vehicular traffic, whether designated as a street, highway, thoroughfare, arterial, parkway, throughway, road, avenue, lane, place or however otherwise designated.
STREET WIDTH. The shortest distance between the lines delineating the right-of-way of a street.
SUBDIVIDER. The owner, agent, or person having control of such land as the term is used in this chapter.
SUBDIVISION. The division of a parcel of land after the effective date of this chapter into 2 or more lots or parcels. The term includes resubdivision and, when appropriate to the context, shall relate to the process of subdividing or to the land subdivided.
SURVEYOR. The registered surveyor appointed or engaged by the Council for the purpose of attaining the goals and complying with the requirements of this chapter.
THOROUGHFARE. A street primarily designated to carry large volumes of traffic and provide for vehicular movement between and among large areas.
ZONING ORDINANCE. The zoning ordinance controlling the use of land as adopted by the city.
