§ 151.04 ESTABLISHMENT OF HERITAGE PRESERVATION COMMISSION.
   There is hereby established a Heritage Preservation Commission.
   (A)   Members. The Heritage Preservation Commission shall consist of 5 voting members appointed by the City Council. The members must be persons with a demonstrated interest in and/or expertise in historic preservation. Members must reside within the city. If a member or members of the County Historical Society reside within the city, the Council shall appoint at least 1 member of that Society to the Commission. The Council shall appoint 1 member from the Planning Commission to the Heritage Preservation Commission. Members shall serve without compensation and shall continue to hold office until their successors have been appointed and qualified.
   (B)   Meetings. The Heritage Preservation Commission shall meet at least once annually and more frequently as the Commission's by-laws provide. The annual meeting shall be held in February of each year upon the date the Commission's by-laws provide after the annual appointments by the City Council.
   (C)   Officers. At the annual meeting, the Commission shall elect from its members a chairperson and vice-chairperson who shall be members of the Commission. The Commission may appoint a secretary who need not be a member of the Commission. The chairperson and vice-chairperson shall hold office for a period of 1 year or until their successor qualifies. Officers may be re-elected without limitation. The secretary shall serve at the pleasure of the Commission.
   (D)   Term of office. The terms of Commission members shall be 3 years. Of the members first appointed, 1 shall serve for 1 year, 2 shall serve for 2 years and 2 shall serve for 3 years. Thereafter, the Council shall make such appointments as to accommodate the staggered three year terms here provided.
   (E)   By-laws. The Commission shall adopt by-laws to govern its procedures. The by-laws shall not become effective until approved by the City Council.
   (F)   Reports. By October 31 of each year, the Commission shall submit an annual report to the State Historic Preservation Officer summarizing the Commission's activities, including designations, reviews and other activities during the previous 12 months. A copy of the report shall be delivered to the City Council.
   (G)   Budget and funding. On or before September 1 of each year, the Commission shall submit to the City Council a proposed budget outlining all costs, if any, of its operation and the source of any revenues received other than from the city. Any funding of the Commission by the city shall be at the sole discretion of the City Council.
