135.02 SALE OR OTHER DISPOSITION OF SURPLUS PROPERTY.
   The Village Administrator is authorized and directed to provide for the sale of surplus equipment and supplies, including motor vehicles, in the following manner:
   (a)   At such times as equipment, including motor vehicles, and supplies of the Village serve no useful municipal purpose, the Village Administrator shall provide for the sale of such equipment or supplies as provided in this section. Such determination shall be made not less than once during each calendar year.
   (b)   Sale of surplus equipment, as determined under subsection (a) hereof, shall be sold by the Village Administrator by one or more of the following methods:
      (1)   Surplus property with an estimated value of five thousand dollars ($5,000) or more shall be sold by either of the following methods:
         A.   By the acceptance of sealed bids, after advertising not less than one time in a newspaper of general circulation in the Village.
         B.   By public auction, after advertisement for not less than one time in a newspaper of general circulation in the Village.
      (2)   Surplus property having an estimated value less than five thousand dollars ($5,000) shall be sold or disposed of by the Village Administrator at the highest attainable price but without the necessity of sealed bid or public auction. Property not purchased and having no marketable value may be donated upon approval of the Village Administrator.
   (c)   The proceeds for the sale of surplus property shall be deposited in the Village Treasury to the credit of the division having jurisdiction and control over such property.
   (d)   The Village Administrator shall keep full and accurate records of the sale of such property.
   (e)   The Village Administrator shall estimate the value of equipment or supplies to be sold under the provisions of this section. The sale of equipment or supplies having an estimated value in excess of five thousand dollars ($5,000), shall be authorized by Council before sale as provided in subsection (b)(1) hereof. The authorization shall be made by motion entered upon the minutes of Council.
