1301.03 SIDEWALK CONSTRUCTION ABUTTING NEW BUILDINGS.
   (a)   Whenever a dwelling house, business building, commercial building, office building, institutional building or any other building is about to be constructed on a lot or parcel of land which abuts any street, the owner, developer or contractor shall apply for and obtain, simultaneously with the issuance of the building permit for such construction, a permit for the construction of sidewalks abutting such land, and shall construct the sidewalks prior to the final inspection and approval of the building construction.
   (b)   The Planning Commission, upon its determination that the public safety and general welfare do not require the construction of sidewalks, may waive the provisions of this section for the construction of commercial and industrial buildings.
