913.01 DEFINITIONS.

   (a)   Commission: shall mean "Shade Tree Commission."

   (b)   dBH: shall mean "diameter at breast height" or diameter of the tree at four-and one-half feet above ground level.

   (c)   Lawn Strip, Tree Lawn or Curb Strip: is that part of a street or highway right-of-way outside of the portion improved for travel, including the sidewalk and lawn area between the side walk and contiguous street or highway, but not alleys.

   (d)   Large Trees: shall mean trees attaining a height or forty-five feet or more.

   (e)   Major Tree: means a living tree with a trunk diameter of at least six inches dBH (diameter at Breast Height), which is measured at a point four and one-half feet above ground level.

   (f)   Medium Trees: shall mean trees attaining a height of thirty to forty-five feet.

   (g)   Park: shall include all public parks.

   (h)   Park Plants: shall mean trees, shrubs, bushes, and all other woody vegetation in public parks having individual names, and all areas owned by the Village, or to which the public has free access as a park.

   (i)   Person: includes any person, firm, partnership, association, corporation, company, or organization of any kind.

   (j)   Public Places: shall include all other grounds owned by the Village of Centerburg, Ohio.

   (k)   Public Trees: shall include all shade and ornamental trees, now or hereafter growing on any street, including lawn strip, curb strip or any other public lands.

   (l)   Property Line: shall mean the legal boundary line on the outer edge of street or highway.

   (m)   Shade or Ornamental Tree or Shrub: shall mean any and all woody vegetation.

   (n)   Small Trees: shall mean trees attaining a maximum height of thirty feet.

   (o)   Street or Highway: means the entire width of every public way or right-of-way when any part thereof is open to the use of the public, as a matter or right, for purposes of vehicular and pedestrian traffic.

   (p)   Street Trees: Shall mean trees and all other woody vegetation lying between right- of-way lines or either side of all streets, avenues, or rights-of-way within the Village of Centerburg, Ohio.
