909.01 PERMIT REQUIRED; BACKFILLING.
   (a)   Any person desiring to excavate any portion of a Village street or alley shall secure the approval of the Village Administrator, or the Mayor if the Village Administrator is unavailable, at least 48 hours in advance of any such excavation. The Village Administrator shall approve all such excavations when restoration of the streets is assured in accordance with the requirements of this section.
   (b)   Any person desiring to excavate any portion of a street or alley must present to the Village Administrator, in writing the following information:
      (1)   The name and address of the person formally responsible for the restoration of the street or alley.
      (2)   The purpose for the excavation.
      (3)   The date(s) when such construction shall take place.
      (4)   The estimated cost of restoration.
   (c)   The Village Administrator shall require a surety bond or the payment of a cash deposit to the Village in the amount of the full costs of restoration of the street or alley before granting his approval for said excavation unless said excavation is done by a department of the Village.
   (d)   Any person excavating a street or alley must restore the street or alley in the following manner:
      (1)   The area excavated must be filled with packed gravel to a level of six inches from the surface.
      (2)   A layer of four inches of concrete shall be placed upon the packed gravel.
      (3)   A surface layer of two inches of black top hot mix or motopave shall be added in order to match the surface layer of the street or alley.
   (e)   The security deposit or bond shall be returned to the party posting the same upon the successful restoration of the street or alley. In the event that said restoration is not in conformity with this section said deposit shall be used to restore said street or alley without prejudice to the rights of the Village to seek compensation in the event that said deposit is not sufficient.
