6-8-4: USE OF PARKS BY PERMISSION; COMMERCIAL SALES PROHIBITED:
   A.   Permit Required: Any person, group or organization desiring to use a park or any portion thereof on an exclusive basis or any person, group or organization desiring to use the park equipment for public gathering to the exclusion of other persons for the purpose of holding meetings, either public or private in nature, shall do so only after obtaining a reservation permit from the city office and upon payment of an appropriate fee for the privilege of reserving the area for a given period of time. Said permit shall be granted only after the person, group or organization applying for the permit can demonstrate to the city's satisfaction that adequate public restroom facilities are available, and that such public, private or excessive gatherings, meetings or activities can be conducted in a matter that will not be the cause of noise, lighting, parking or other condition, which unreasonably disturbs the adjoining neighborhood.
   B.   Commercial Activities: It shall be unlawful to sell anything in a city park or to engage in any commercial activity in a city park, whether for profit or otherwise, without the prior written consent of the city.
   C.   Overnight Occupancy: Overnight occupancy of the park may be permitted if the occupants are part of an organized group and the group will have competent authorized adult supervision. Prior written consent is to be obtained from the city.
   D.   Slip N' Slides: It shall be unlawful to use slip n' slides on any city-owned property, including in any city parks. Notwithstanding the forgoing, slip n' slides may be used in certain designated city retention basins upon written approval by the City Manager. Any person, group or organization desiring to use a slip n' slide in a designated city retention basin shall do so only after applying for and obtaining a use permit from the City, paying the applicable application fee, and entering into an indemnification and waiver agreement with the City. In determining whether slip n' slide use within a designated city retention basin may be permitted upon a submitted application, the City Manager or his or her designee will consider the following factors:
      1.   The current or suspected conditions of the designated retention basin at the time of the proposed use;
      2.   The current or suspected weather on the proposed day of use;
      3.   The applicant's previous use of slip n' slides on designated retention basins within the city;
      4.   Potential damage that will occur to the designated retention basin or other property at the time of the proposed use;
      5.   Potential safety issues that may arise from use of the designated retention basin requested;
      6.   Any upcoming city or other event or use that will take place at the requested designated retention basin at or near the time of the proposed use;
      7.   The size of the proposed slip n' slide;
      8.   The duration of the proposed slip n' slide use;
      9.   The number of anticipated users of the slip n' slide;
      10.   The method of delivering water to the slip n' slide;
      11.   Any other foreseeable issues or concerns with safety or property damage.
The City Manager (or his or her designee) has wide discretion to deny the application under any or all of the forgoing factors. Any applicant seeking use of a slip n' slide on designated retention basins must use a residential water connection for all private events. (Ord. 09-17-2013A, 9-17-2013; amd.
