6-6-9: PENALTIES:
Any person who violates any provision of this chapter or who fails to comply with any notice issued pursuant to any provision of this chapter, upon being found guilty of the violation shall be subject to the penalties, under nuisance, set forth in the city's fee schedule for each offense. If, as the result of the violation of any provision of this chapter, the injury, mutilation or death of a tree, shrub, or other plant located on city property is caused, the party in violation shall make restitution to the city for the cost of repair or removal and replacement of such tree, shrub, or other plant, whichever is necessary in the opinion of the zoning administrator, or designee; such restriction shall be in addition to any other penalty. The minimum replacement cost for a tree will equal the cost of a two inch (2") caliper tree. (Ord. 10-21-2008A, 10-21-2008)
