§ 133.04 PROHIBITED FENCES.
   Except as otherwise specifically provided in these regulations, in other codes and regulations, the following regulations shall apply to the construction offences. In reference to this section, the roadside is considered the front yard.
   (A)   No fence shall be constructed which will constitute a traffic hazard.
   (B)   No fence shall be constructed in such a manner or be designed as to be hazardous or dangerous to persons or animals; specifically, the use of barbed wire and electrical fences in residential districts is prohibited.
   (C)   (1)   No person shall erect or maintain any fence which will naturally damage the adjacent property, obstruct the view, shut out the sunlight or hinder ventilation or which fence shall adversely affect the public health, safety and welfare.
      (2)   Fences separating residential and non-residential land uses shall not exceed eight feet in height.
   (D)   No fence, except fences erected upon public or parochial school grounds or in public parks and playgrounds, shall be constructed of a greater height than eight feet; provided, however, that, the Board may, by granting an exception, authorize the construction of a fence higher than eight feet if the Board finds the public welfare is preserved.
   (E)   All fences shall conform to the construction standards of the Building Code.
   (F)   (1)   Whenever any land or structure in an I-Industrial District adjoins a R-Residential District, additional side and rear yards shall be provided for landscaping.
      (2)   A ten-foot wide buffer zone shall be provided and contain a shrub border to serve as a screen between the Residential District and the proposed use.
      (3)   The shrub screen shall be planted and adequately maintained by the property owner of the Industrial District.
      (4)   The height of the screen shall not exceed six feet in height or be less than three in height.
   (G)   The finished side of the fence must face the adjoining properties.
   (H)   The side yard of any lot shall be unobstructed by any structure or feature, except a fence or retaining wall that shall be no higher than six feet above the ground level. No fence or closely grown hedge shall be more than six feet in height in any rear yard, and no fence constructed of any type of substance shall be greater in height than 36 inches in any front yard and no hedge shall be greater than 30 inches in any front yard. Any fence or hedge in a front yard shall not be placed any closer than six feet from the front property line.
   (I)   Any perimeter fencing shall require a permit. The fee for the permit is $10.
