§ 10.99 GENERAL PENALTY.
   (A)   (1)   Any person, firm or corporation, their agents or servants, who shall violate any of the provisions of this village code, unless otherwise specifically provided herein, shall be deemed guilty of an offense and, upon conviction thereof, shall be fined in any sum not exceeding $500. A new violation shall be deemed to have been committed every 24 hours of failure to comply with the provisions of this code.

      (2)   In any case where any person, including a partnership or corporation, shall have been found guilty of the violation of any ordinance of the village, such person shall pay the costs of prosecution and court costs and shall stand committed until the same shall have been paid in full.

      (3)   The term “village police” shall apply in all instances to all other law enforcement officials, including Nebraska State Patrol Officers and the Cass County Sheriff and his or her Deputies. Whenever this code empowers the village police to take any action, such empowerment shall extend to and apply equally to any Nebraska State Patrol Officer or the Cass County Sheriff or his or her Deputies.

   (C)   (1)   Whenever a nuisance exists as defined in Titles IX and XIII of this code, the village may proceed by a suit in equity to enjoin and abate the same, in the manner provided by law.
      (2)   Whenever, in any action, it is established that a nuisance exists, the court may, together with the fine or penalty imposed, enter an order of abatement as a part of the judgment in the case.
