§ 32.02 SEWER COMMITTEE.
   (A)   Creation. There is hereby created a committee of the city to be known as the City Sewer Committee, which shall be comprised of five members.

   (B)   Powers and duties. The Committee shall have all of the powers, and duties, provided by A.C. § 14-235-207, as the same may be amended from time to time. As set forth therein, the Sewer Committee will have the power to take all steps, and proceedings, and to enter into all contracts, and agreements, necessary, or incidental, to the performance of its duties, except any contract relating to financing, or any trust indenture, shall be approved by the City Council before it is effective. The Committee may employ engineers, architects, inspectors, managers, and the like, as may be necessary in the execution of its powers and duties, and may fix their compensation. All compensation, expenses, and liabilities shall be paid solely from funds provided to the City Sewer Committee, and the Committee may not bind the municipality beyond this amount.
      (1)   No contract, or agreement, shall be made with a contractor for materials, or labor, for over $10,000 without advertising for bids. Bids must be publicly opened, and award made to the best bidder, with power in the Committee to reject any, or all, bids.
      (2)   After construction, or acquisition, of the works, the Committee shall:
         (a)   Operate, manage, and control the works, and may order, and complete, any extensions, betterments, and improvements if funds are available, or are made available;
         (b)   Establish rules, and regulations, for the use, and operation, of the works, and other sewers, and drains, connected to them; and
         (c)   Do all things necessary, and expedient, for the successful operating of the works.

   (C)   Members.
      (1)   The members of the Sewer Committee shall be appointed by the Mayor, and shall become valid following confirmation of such appointments by the City Council. The members shall consist of the following:
         (a)   Two City Council members;
         (b)   One citizen of the city;
         (c)   The Director of Public Works for the city; and
         (d)   The Water and Sewer Clerk for the city.
      (2)   The Mayor of the city shall serve as an ex-officio member of the Sewer Committee. The terms of service for the citizen of the city and the City Council member shall be for a period of two years, and the terms of service for the other members of the Committee shall be for the term they maintain the position of Director Public Works, Water and Sewer Clerk, and Mayor.
   (D)   Authority of the City Council. The Committee shall function under the control of the City Council. The City Council may remove any member of the Committee with, or without, cause, and may appoint any substitute members in case of death, removal, or resignation.
