(A) Design barriers. The provisions of this section shall apply to design of barriers to all swimming pools. These design controls are intended to provide protection against the potential drowning and near drowning by restricting access to such swimming pools.
(B) In-ground pool requirements. All outdoor in-ground swimming pools shall be surrounded by a barrier. When (in-ground/below-grade) hot tubs are within the confines of a pool, this section shall be applicable as well.
(1) The top of the barrier shall be not less than 48 inches above grade. Such height shall exist around the entire perimeter of the swimming pool.
(2) Openings in the barrier shall not allow passage of a four-inch diameter sphere.
(3) The site plan for swimming pool, barrier, and septic with lateral lines shall be submitted with swimming pool application.
(4) Swimming pool fences and gates are required to have a minimum height of four feet and a maximum height of eight feet. Additionally, gates must have child-resistant latches.
(C) Above ground swimming pool barrier.
(1) An above-ground pool wall, itself, shall be permitted to be the barrier where the pool structure is on grade and the wall is above-grade for the entire perimeter of the pool.
(2) Where the mean of access is a ladder or steps, the ladder or steps shall be capable of being secure, locked, or removed to prevent access, or the ladder or steps shall be surrounded by a barrier that meets the barrier requirements set forth in division (B) above.
(D) Gates. Access gates shall be equipped to accommodate a locking device. Pedestrian access gates shall open outward, away from swimming pool, and shall be self-closing and have a self-latching device.
(E) Requirements.
(1) Application shall require a plan review minimum of two weeks. A site plan is required for the location of the pool and meets all requirements according to Appendix Exhibit 1.2, Site Plan, of the zoning ordinance.
(2) Pre-site visit: For barriers, the pool layout, utility locations, septic locations shall be marked.
(3) Electrical bonding: Pool bonding, deck bonding, and equipment bonding per NEC 2017 requirements shall be included.
(4) Plumbing: Gas pressure, gas yard line, and gas service per APC 2006, or the most current edition, shall be included.
(5) Scheduling inspections: Applicants should contact the City Building Inspection Department for inspection requests.
(F) Fees. Swimming pool fees are as follows:
(1) The swimming pool permit fee shall be $250, with electric or plumbing permits also required.
(2) The completion deposit for fence barriers shall be $1,000. Fees are to be paid prior to a swimming pool permit issuance.
(3) If a perimeter fence is pre-existing and in compliance with the provisions herein, it is exempt from the deposit requirement.
(4) A perimeter (privacy) fence meeting the provisions contained herein shall be installed prior to release of pool permit and prior to any construction. An opening is allowed for access of equipment to construct the pool. The completion deposit shall be applicable.
(5) If a perimeter fence is to be installed only around the pool and not the perimeter (privacy fence), then the completion deposit shall be required prior to release of permits and construction.
(G) Violation. If water is placed in a pool prior to barrier installation, then the completion deposit shall be surrendered to the city. Any fines assessment shall still be applicable.
