(A) All prospective red dirt mine facilities within the city limits, including the expansion of the operations of an existing red dirt mine facility, on to real property that has not received the zoning approval for the operation of a red dirt mine facilities, in accordance with the ordinances of the city, must secure the proper zoning approvals before the commencement of the operation of a red dirt mine facility.
(B) Before the commencement of the operation of a red dirt mine facility within the city limits, a prospective red dirt mine facility must receive an issued red dirt mine facility operation permit from the city, as set forth in § 114.06.
(C) Red dirt mine facilities within the city limits shall only be allowed to operate during daylight periods between 7:00 a.m. through 7:00 p.m., Monday through Saturday. Despite the hours of operation set forth above, under no circumstances shall operations of the red dirt mining facilities be allowed before daylight in the morning, or after dark. It shall, in any case, be a violation of this chapter for a red dirt mine facility to operate before 7:00 a.m., or after 7:00 p.m., Monday through Saturday.
(D) No red dirt mine facilities within the city limits shall be allowed to operate on Sundays, or the recognized holidays of Independence Day, Thanksgiving Day, Christmas Day, and New Year’s Day.
(E) All red dirt mines within the city limits shall comply, at all times, with all federal, and state (including the State Department of Environmental Quality), laws, rules, regulations, and requirements. Specifically, all red dirt mines within the city limits shall be in compliance with the State Open-Cut Land Reclamation Act, being A.C. §§ 15-57-301 et seq., and the State Quarry Operation, Reclamation, and Safe Closure Act, being A.C. §§ 15-57-401 et seq.
