(A) Any person refusing, or failing, to pay any charge assessed pursuant to the provisions of this chapter, including both the failure to pay for residential solid waste, and recycling, collection, and the failure to pay for the collection of commercial, or industrial, waste, shall be guilty of a violation of this chapter, and punished as provided by division (B) below.
(B) Whoever violates any provisions of this chapter shall be guilty of a misdemeanor, and may be punished by a fine of not less than $10, nor more than $500 for the first offense, and not less than $10, nor more than $250 for each offense each day, plus court costs and reasonable attorney fees for each violation.
