(A) Submission procedure.
(1) For every subdivision within jurisdiction established by § 152.05, which does not qualify for the abbreviated procedure, the subdivider shall submit a preliminary plat, which shall be approved by the Planning Board before any construction, or installation of improvements may begin.
(2) Fourteen copies of the preliminary plat, including 12 copies and two original, as well as any additional copies which Planning Board determines are needed to be sent to other agencies shall be submitted to the Subdivision Administrator (SA) at least 21 days prior to the next regularly scheduled Planning Board meeting at which the subdivider desires the Planning Board to review the Preliminary Plat.
(3) Preliminary plats shall meet the specifications of the Brunswick County Register of Deeds for recording subdivision plats. Plats may be placed on more than one sheet with appropriate match lines.
(4) The filing fee as required in § 152.36 shall accompany submission of the preliminary plat. The fee schedule shall be set by the Board of Commissioners and available at the Town Hall.
(B) Review by other agencies. Concurrent with submission of the preliminary plat to the Subdivision Administrator, the subdivider shall submit copies of the preliminary plat and any accompanying material to other officials and agencies concerned with new development including but not limited to: the district highway engineer as to proposed streets, highways and drainage systems; the appropriate Brunswick County and/or state agency as to proposed water and sewerage systems; the North Carolina Department of Environment, and Natural Resources, Land Quality Section as to the erosion control requirements; the Brunswick County Board of Education as to proposed school sites, if any, and any other agency or official designated by the Planning Board for review and recommendation. The Subdivision Administrator will advise the subdivider concerning which agencies are applicable for a given plat.
(C) Review procedure.
(1) The Technical Review Committee (TRC) shall review the plat for compliance with regulations and good planning practices and the Subdivision Administrator shall present the plat and the Committee's recommendations to the Planning Board.
(2) The Technical Review Committee will include the Subdivision Administrator and other appropriate officials as may be designated by the Town Board of Commissioners to ensure thorough review.
(3) The Planning Board shall review the preliminary plat at or before its next regularly scheduled meeting, which follows at least 21 days after the plat is submitted and it receives comments from the appropriate agencies. Additionally, all preliminary plats for proposed subdivisions with private street(s) must be approved by Board of Commissioners.
(4) The Planning Board shall review the preliminary plat along with the recommendations of the Subdivision Review Committee and, in writing, recommend approval, conditional approval with conditions to bring the plat into compliance, or disapproval with reasons within 45 days of its first consideration of the plat. Failure of the Planning Board to make a written recommendation within this time period shall be deemed as approval by the Planning Board.
(5) During its review of the preliminary plat the Planning Board may appoint an engineer or surveyor to confirm the accuracy of the plat (if agreed to by the Board of Commissioners). If substantial errors are found, the cost shall be charged to the subdivider and the plat shall not be recommended for approval until such errors have been corrected.
(6) If the Planning Board disapproves the plat, the reasons therefor shall be stated, in writing, and submitted, along with the original and four prints of the plat, to the subdivider who may make the recommended changes and submit a revised plat for Planning Board approval without paying an additional filing fee. If the Planning Board approves the preliminary plat conditionally, the conditions and reasons thereof shall be stated, in writing, and, if necessary, the Planning Board may require the subdivider to submit a revised plat. Resubmission of a revised plat does not require and additional filing fee. Resubmission must be made within 60 days and submitted at least one week prior to the Board meeting.
(7) If the Planning Board approves the preliminary plat, such approval shall be noted on the three copies of the plat. One print and one original reproducible drawing of the plat shall be returned to the subdivider, or his/her agent, and one copy of the print shall be retained by the Subdivision Administrator.
(8) Approval of the preliminary plat is authorization for the subdivider to proceed with the construction of the necessary improvements in preparation for the final plat.
