§ 93.17 CAMPFIRES OR BONFIRES ON THE BEACH.
   (A)   Campfires of bonfires on the beach shall require a permit issued by the Town Manager or their designee. Permit shall specify:
      (1)   Address, date and time of the campfire/bonfire.
      (2)   Name, local address and telephone number of applicant in addition to the applicant’s permanent address and telephone number if different from the local information.
   (B)   Permitted fires shall be:
      (1)   Burned in a non-combustible container or excavated pit of a dimension no larger than four feet long by four feet wide.
      (2)   Fueled to a maximum height of two feet but never higher than the height of the container or pit.
      (3)   Located landward of the high tide line as established by the most recent high tide, and a minimum of 50 feet from any vegetation and a minimum of 100 feet from any structures or established turtle nests.
      (4)   Extinguished by 11:00 p.m.
   (C)   Permit holder shall:
      (1)   Be at least 21 years old and present at all times during fire event.
      (2)   Conspicuously post permit within reasonable proximity (50 feet) from the fire.
      (3)   Have sufficient equipment on site to extinguish the fire.
      (4)   Completely remove and properly dispose of all fire debris from the beach no later than 10:00 a.m. the day after the fire.
      (5)   Not bury debris on the beach.
      (6)   Return fire site to an undisturbed “as before the fire” condition.
   (D)   All fires are prohibited during turtle nesting season (May 1 through August 31) and if wind speed is or is forecasted to be greater than 20 miles per hour. A previously issued fire permit shall be immediately revoked by the appropriate public safety official should unexpected winds that exceed 20 miles per hour arise during the conduct of a burn. Should fire permit be revoked during the conduct of a burning fire, permit holder will immediately extinguish all fire and perform debris removal as previously aforementioned.
   (E)   A refundable cash deposit of $100 shall be remitted to town at time of permit issuance and redeemed to permit holder the day after the fire by 12:00 p.m. Failure to return the, beach to an “as before” condition as determined by the Town Manager or failure by permit holder to collect deposit from town within three normal administrative working days of fire event will result in forfeiture of the deposit.
   (F)   The Town Manager shall ensure all appropriately involved public safety agencies and volunteer groups are advised of permitted fires.
   (G)   Beach fires conducted by the town are exempt from these regulations.
