§ 71.01 PARKING ALONG CASWELL BEACH ROAD (STATE ROAD 1100).
   (A)   No person shall park a vehicle or permit it to stand, whether attended or unattended:
      (1)   Along either side of Caswell Beach Road (State Road 1100) within the town limits, unless the vehicle is disabled to such an extent that it is impossible to avoid stopping and temporarily leaving the vehicle along the side of the road;
      (2)   In the public parking facilities located opposite the Duke Power property or on the Oak Island Lighthouse property when those facilities are closed as approved by the Town Manager, including but not limited to closures to accommodate tours and special events or needs of those who have contracted to provide services to the town; or
      (3)   In violation of any time limits or other restrictions from time to time approved by the Town Manager and posted for those public parking facilities.
   (B)   This section shall not:
      (1)   Be construed to prohibit or restrict the operation of police cars, fire trucks, emergency rescue equipment or other official vehicles while on official duty;
      (2)   Apply to town staff, any governmental agency, its employees, agents, contractors and subcontractors and their vehicles while on official duty;
      (3)   Apply to persons with disabilities and their vehicles or devices designed to propel the persons with disabilities to the strand of the beach area;
      (4)   Apply to approved volunteers to the extent allowed by permit issued by the town; and
      (5)   Apply to other persons to the extent permitted by the Town Manager.
   (C)   Parking in handicap parking spaces.
      (1)   Any automobile, truck or vehicle that is found to be parked in a properly designated handicap parking space without an authorized license plate or removable windshield placard that displays the international handicap symbol is in violation of this section. Any vehicle parked in violation of this section may be towed by a Caswell Beach police officer.
      (2)   The officer shall not be held to answer in any civil or criminal action to any owner, lienholder or other person legally entitled to the possession of any vehicle towed from a space pursuant to this section.
