§ 150.073 FILLING, GRADING, AND EXCAVATION.
   (A)   Quantity. The amount of fill added to a lot will be in accordance with CAMA requirements, will be no greater than one foot above the crown of road and will not be greater than is necessary to meet the Health Department requirements for an improvement permit. Fill will also be limited by the height of the adjacent lot(s) that have been developed and cannot exceed the developed lot(s) in height by greater than one foot. Any differential in fill greater than one foot at the common line of the two lots, the higher lot must construct a wall, bulkhead, or a satisfactory containment device to prevent the fill and surface water from running on the lower lot. Fill and sand will be stabilized in accordance with CAMA to prevent erosion.
   (B)   Lowering level. In lowering the level of a lot by grading or removing sand, the height limit will not exceed one foot above or below the adjacent developed or undeveloped lot(s) when finished and stabilized. Stabilization will be in accordance with CAMA provisions to prevent erosion.
   (C)   Changes.
      (1)   Any proposed change to the natural topography of the land in the town must be approved and the conditions of the approved and the conditions of the approval shall be stated on the CAMA permit issued for this purpose prior to any work being accomplished. Before issuing the permit, the Building Inspector will insure by an on-site inspection that proposed topographic changes will not destroy the integrity and protective nature of the dune system or create conditions which could result in its destruction.
      (2)   These topographic changes shall consist of but not be limited to:
         (a)   Sand or earth moving by bulldozer or other equipment;
         (b)   Removal of natural vegetation;
         (c)   Construction of sand fences or other devices designed to alter the natural movement of drifting sand;
         (d)   Covering of sand or other surfaces with a stabilizing clay or marl;
         (e)   Any grading or preparation of a lot for the location of a structure; and
         (f)   Any earth disturbing activity.
   (D)   Survey. A survey with elevations at the street intersections with the lot completed by a licensed surveyor is required prior to issuance of a CAMA permit.
