§ 151.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B) If the Building Commissioner provides written notice to an owner that the owner has failed to install or maintain a placard on the structure in violation of § 151.19, and the owner fails to correct the violation not later than ten business days after receiving the written notice, the owner is liable for a civil penalty of not to exceed $100 per day during the period beginning ten business days after the owner receives written notice of the violation from the unit, and until the date the violation is corrected. A penalty imposed under this section may not exceed $3,000 per structure per year.

   (C)   Any person violating any provision of §§ 151.15 through 151.20 may be subject to a fine in any sum not exceeding $2,500. The assessment of a monetary penalty shall in no way limit the operation of the penalties provided elsewhere in this subchapter.

   (D)   (1)   Any person who shall continue any violation of §§ 151.45 through 151.58 beyond the time limit provided for correction of any violations of §§ 151.45 through 151.58, or who performs any act prohibited therein, or shall fail to perform any duty lawfully enjoined, or who shall fail, neglect, or refuse to obey any lawful order given by the County Health Officer, shall be punished for the first offense by a fine not to exceed $500. Each day a violation of §§ 151.45 through 151.58 continues shall constitute a separate offense for which a separate fine may be levied.
      (2)   Any person (except for a property owner who complies with the requirements of § 151.50(H)) constructing, installing, repairing, replacing, or altering any OSS who is not certified in the county shall be deemed to be in violation of this subchapter. A person who is in violation of this subchapter shall be fined for the first offense not to exceed $2,500; for the second and each subsequent offense, not to exceed $5,000. Each violation of this subchapter shall constitute a separate violation.
