(A) Generally.
(1) Investigation by the County Highway Department. Whenever the County Highway Department determines on the basis of an engineering and traffic investigation that the maximum speed permitted by the speed regulations enacted by the State General Assembly is greater or less than reasonable and safe under the conditions found to exist on a highway, or part of a highway, within the county, the County Highway Department may determine and declare a reasonable and safe maximum limit thereon, subject to the approval of the Board of County Commissioners.
(2) Power to increase or reduce speed limit. The County Highway Department shall not, in any event, reduce the speed within urban districts to less than 20 mph, or increase the speed within urban districts to more than 55 mph during daytime, and 50 mph during nighttime.
(3) Signs required. Any altered limit established as herein authorized shall be effective at all times, or during hours of darkness, or at other times as may be determined, when appropriate signs giving notice thereof are erected on such highway.
(4) Jurisdictional limits. The provisions of this schedule shall not apply to any portion of any highway within the county, which is located within the corporate limits of any incorporated city or town within the county, nor shall they apply to any highways, or extension thereof, in the state highway system.
(5) Penalties. Any person who violates any provisions of this schedule shall be guilty of a Class C infraction.
(B) Twenty-five mph speed zone. On the basis of engineering and traffic investigation that the maximum speed limit permitted under state law is greater than reasonable and less than safe under the conditions found to exist on certain highways, or parts of highways in the county, the Board of County Commissioners determine that the following limits shall be the maximum lawful speed on the following listed highways, and no person shall drive a vehicle on the highways at a speed in excess of the maximum limit:
