§ 94.07 PERMITTED EXEMPTIONS.
   (A)   An exemption may be permitted by the City Council for acts that are prohibited by this chapter by submitting a request to the City Recorder at least 30 days prior to the time for which the exemption is sought. The request shall state the provision for which an exemption is being sought, the period of time the exemption is to apply, the reason the exemption is sought, and any other supporting information which the city may reasonably require.
   (B)   The City Council may consider the following in deciding whether to grant an exemption:
      (1)   The nature and duration of the sound emitted;
      (2)   Whether the public health, safety or welfare could be endangered;
      (3)   The duration of the exemption;
      (4)   The nature of the surrounding properties;
      (5)   The benefit to the community; and
      (6)   Whether the applicant has a record of compliance with the terms of previously granted exemptions.
   (C)   Notice shall be given to affected neighborhood associations, owners, and residents of property likely to be affected by the exemption. The City Recorder, in his/her sole discretion, may designate the area and manner in which notice must be given.
   (D)   Persons affected by the exemption may present objections, in writing or in person, regarding the exemption to the City Council at any regularly scheduled City Council meeting. The City Council may consider such objections and, in their sole discretion, decide whether to grant, revoke, or deny the exemption.
