(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) A violation of any of the provisions of § 91.052, or of the burning rules as established by resolution, is a Class A infraction and shall be punished by a fine of not less than $50 for the first incident, $100 for the second incident and $300 for the third and all subsequent incidents. An INCIDENT is defined as each time a fire is started, whether it is a new fire or the re-ignition of a previous fire, and each 24-hour period between 12:00 a.m. and 11:59 p.m. will be considered a separate incident if a fire is continuous.
(C) (1) A penalty shall be assessed if a person fails to pay the fee when due.
(2) The penalty under division (C)(1) above shall be calculated as:
(a) Five percent (0.05) of the total fee liability of the account but not less than $5 if failure is for a period more than 84 days from the invoice date; and
(b) An additional penalty of 20% (0.20) of the total fee liability but not less than $50 if the failure is for a period of six months from the invoice date.
