When any vehicle has been towed, the owner or person entitled to possession thereof may obtain possession upon showing adequate evidence of a right to its possession and paying the charges due for towing and storage, and a fine in the amount of not less than $35 in any case where a vehicle was parked in a hazardous manner, and a fine in the amount of not less than $20 in all other cases. The vehicle shall only be released to a licensed and insured driver if the vehicle is to be driven from the tow site.
