If no person is in charge of such vehicle, but if the vehicle is not in a position as to be a hazardous vehicle or as to prevent the proper parking of another vehicle, the law enforcement officer may place a traffic citation in or on the vehicle or have the vehicle towed as provided for in § 73.53. If the vehicle is occupied the citation shall be served upon the occupant.
