4-5-8: CONSUMPTION ON PREMISES:
Retailers who do not possess a valid license for the retail sale of beer or liquor by the drink shall not permit consumption of wine on the licensed premises and may sell the wine only in its original unbroken, sealed container, except as hereinafter specifically provided. Wine sold for consumption on the retailer's premises may be sold only during hours that beer or liquor by the drink may be sold pursuant to the laws of this State. Wine sold by the retailer for consumption off the premises of the retailer may be sold only during the hours that beer may be sold pursuant to the laws of this State.
Exception: Retailers who possess valid State and County licenses for consumption of wine on the licensed premises and who possess a valid wine license issued by the City may permit consumption of wine on the licensed premises so long as no charge is imposed for such wine consumed on the licensed premises. Retailers may permit wine served on the licensed premises at no charge to be consumed on the licensed premises only during the hours that beer or liquor by the drink may be sold pursuant to the laws of this State.
