8-2-12: AWNINGS, SHEDS, SIGNS:
   (A)   All awnings or sheds over the sidewalk around the public square shall be supported with posts or supports of sufficient size and strength to guard against danger from the same falling. They shall be made as nearly uniform as possible. (Ord. 20, 12-5-1908; amd. 1979 Code)
   (B)   The Codes Enforcement Officer shall give directions as to all awnings or sheds to be built, so as to have them as nearly uniform as may be; but anyone feeling aggrieved by any order or requirement of the Codes Enforcement Officer may be heard by the City Council when in session, and its order shall be final in the premises. No awning or shed shall be built lower than eight feet (8') above the sidewalk.
   (C)   No person shall be permitted to suspend any sign over or across any sidewalk unless the same shall be at least eight feet (8') above the sidewalk, and any person who shall violate this subsection shall be deemed guilty of a misdemeanor; and the Codes Enforcement Officer shall take down all awnings or sheds or cross signs which may be built or placed less than eight feet (8') above the sidewalk.
   (D)   Whenever any awning, shed or sign shall become dangerous from decay of material or any other cause the Codes Enforcement Officer shall notify the owner or occupant of the premises to repair or take the same down; and if any owner or occupant shall neglect to comply with such notice within a reasonable time thereafter, he shall be subject to penalty of not less than the cost and expense of taking the same down; and it is made the duty of said Codes Enforcement Officer to abate such nuisances after such reasonable notice has been given, and to institute proceedings to collect the fine therefor and the expense of the abatement.
