§ 92.047 PUBLIC NOTICE.
   In order to exercise the powers conferred by this subchapter, there must first be:
   (A)   A petition by a majority of the property owners whose property abuts or has direct access to the road to be improved (“the affected property owners”) in which they request the necessary improvement or construction;
   (B)   Public hearing upon the petition after ten days notice in a newspaper regularly published in the county;
   (C)   Approval of said petition by the County Commissioners; and
   (D)   The passage of an appropriate ordinance setting forth the improvements or construction to be made, the property owners affected, and all material terms of the annual benefit assessments to pay the portion of the cost to be levied for said improvements or construction.
