(A) If an underground storage tank is privately owned, the property owner may convey in fee simple to the county the tank and an area surrounding the tank, provided the tank and area surrounding the tank meet the county’s standards and requirements for a regional fire protection water source. The property owner shall also convey to the county an easement of access to the tank.
(B) If the county accepts conveyance of the tank, the county shall maintain the operational integrity of the tank and replace the tank, if necessary.
