(A) The County Commissioners may grant a waiver of all or a portion of the development impact fees imposed under this subchapter.
(B) Any person seeking a waiver shall submit the request in writing to the Director, Department of Management and Budget, or its successor agency. The Director, Department of Management and Budget, or its successor agency, shall be authorized to promulgate rules and standards for the application and review of all waiver requests.
(C) The Director, Department of Management and Budget, or its successor agency, will examine each request on the merits and present each duly submitted request to the County Commissioners for consideration and decision.
(D) The County Commissioners will consider granting waivers for the following types of projects:
(1) Projects owned by nonprofit organizations;
(2) Projects creating workforce housing;
(3) Projects creating affordable housing; or
(4) Projects for a similar public purpose that will benefit the local community.
(E) The decision of the County Commissioners to grant or deny a waiver is final and not subject to appeal.
