8-4-5: GARBAGE RECEPTACLE REQUIREMENTS:
   A.   Regulations For The Use Of Polycarts (If Available):
      1.   All residents will be required to use polycarts if on an established polycart pickup route. No trash will be picked up that is placed in cans, barrels or on the ground.
      2.   Each such residence will be supplied with a numbered polycart that will be registered to them with no deposit required.
      3.   Anyone whose services are disconnected for non-payment will have their polycart picked up and sanitation services will not be provided until the bill is paid in full.
      4.   Residents who transfer from one location to another will have their numbered polycart moved with them to the new location.
      5.   Residents are responsible for the safety and upkeep of the polycart. If it is lost or stolen the resident will be required to pay the full replacement price for their polycart.
      6.   Trash must be bagged unless it is boxes, or other dry items.
      7.   Household trash only. No limbs, chemicals, paint, batteries, metal objects or construction materials will be picked up.
      8.   Polycarts are to be placed on the curb in front of the residence or at any other place established by the sanitation crew. (Ord. 282, 8-27-2015)
   B.   Receptacles Required: The owner or occupant, as the case may be, of any and all premises in the Town not on an established polycart pickup route and not subject to the provisions of subsection A of this section shall procure, supply and place up to four (4) watertight, plastic or other lightweight cans that must be of sufficient size to hold not more than thirty three (33) gallons, with close fitting covers and rack for said cans, except that no rack shall be required for curbside pick up.    C.   Placement For Collection: Said plastic or other lightweight cans shall be placed on the alley, or in case it is more convenient to the collector, then said cans may be placed on some place on the lot or premises outside the buildings for access to the same.    D.   Depositing Garbage In Receptacles: Said owner or occupant shall deposit all garbage in said cans placed in the alley or other convenient places on the premises, so that the same may be removed at stipulated times from said premises.
   E.   Maintenance Of Receptacles; Sanitary Condition: It shall be the duty of the owner of the said cans to keep them clean at any and all times, and to maintain them in a sanitary condition. (1992 Code § 16-35; amd. Ord. 241, 2-15-2007)
   F.   Businesses; Differing Requirements: The requirements for plastic or other lightweight containers shall not apply to all commercial businesses; such entities shall be required to deposit refuse in containers acceptable to the Municipal collection agent.
   G.   Violation; Surcharge: It shall be unlawful and an offense for any person, firm or corporation to violate the provisions of this section, and those in violation of same shall be assessed a surcharge of five dollars ($5.00) per each such violation or occurrence which shall be added to the next month's utility billing statement.
