8-3-4: SEWER RATES AND REGULATIONS 1 :
The following rates and charges shall apply, and rules and regulations shall be adhered to by users of the sewerage system: (Ord. 943, eff. 12-1-1977; amd. 2006 Code)
   A.   Monthly Rates:
      1.   Rates And Charges Established: From and after the effective date hereof, the rates and charges for the use and services of the sewage system of the City shall be paid monthly at the following rates:
         a.   Rates effective June 1, 2005:
            (1)   City rates:
For the first one thousand (1,000) gallons used per month, seven dollars ($7.00) minimum rate.
For gallons in excess of the first one thousand (1,000) gallons used per month, three dollars ($3.00) per one thousand (1,000) gallons.
            (2)   Rural rates:
For the first one thousand (1,000) gallons used per month, eight dollars twenty six cents ($8.26) minimum rate.
For gallons in excess of the first one thousand (1,000) gallons used per month, three dollars twenty six cents ($3.26) per one thousand (1,000) gallons.
         b.   Rates effective June 1, 2006:
            (1)   City rates:
For the first one thousand (1,000) gallons used per month, seven dollars ($7.00) minimum rate.
For gallons in excess of the first one thousand (1,000) gallons used per month, four dollars ($4.00) per one thousand (1,000) gallons.
            (2)   Rural rates:
For the first one thousand (1,000) gallons used per month, eight dollars twenty six cents ($8.26) minimum rate.
For gallons in excess of the first one thousand (1,000) gallons used per month, four dollars twenty six cents ($4.26) per one thousand (1,000) gallons. (Ord. 1361, 3-6-2006)
         c.   Rates effective December 1, 2017:
            (1)   City rates:
For the first one thousand (1,000) gallons used per month - seven dollars ($7.00) minimum rate.
For gallons in excess of the first one thousand (1,000) gallons used per month - five dollars fifty four cents ($5.54) per one thousand (1,000) gallons to five thousand (5,000) gallons.
For gallons in excess of the first five thousand (5,000) gallons used per month - five dollars ($5.00) per one thousand (1,000) gallons used. (Ord. 1540, 11-21-2017)
            (2)   Rural rates:
For the first one thousand (1,000) gallons used per month, eight dollars twenty six cents ($8.26) minimum rate.
For gallons in excess of the first one thousand (1,000) gallons used per month, five dollars twenty six cents ($5.26) per one thousand (1,000) gallons. (Ord. 1361, 3-6-2006)
      2.   City Tax: A Carmi City Tax of five percent (5%) shall be added to the sewer rate charges. (Ord. 1540, 11-21-2017)
   B.   Tap Fees: Any person desiring a new connection to the sewage system shall pay to the City, in advance, a hookup fee as follows:

   C.   Application For Service: Businesses or individuals desiring services from the sewage system shall make application to the City office. Said application shall be processed and connection made at customer's expense by a licensed plumber and the City before being placed in service.
   D.   Service Line Installation And Maintenance: The City sewage system shall be responsible for installing and maintaining the service lines of the sewage system and shall have the right to refuse service when the capacity of the system will not permit more usage.
   E.   Nonliability Of City: The City shall not be liable for damages or injuries to persons and/or property resulting from the installation and maintenance of said system.
   F.   Extensions Paid For By Users; City Authority:
      1.   Payment In Advance: Any extensions to the sewage system shall be paid for by the users of said extensions before said extensions are installed.
      2.   Limitations Imposed By City: The City maintains the right to limit the number and sizes of these extensions to conform with the use and capacity of the system, and also reserves the right to allow extensions to the system as it deems advisable.
      3.   Approval By Local, State And Federal Agencies: All plans and specifications shall be reviewed and approved by all appropriate City, State and Federal agencies, and any extension proposed, or connection made is subject to said review and approval. (Ord. 943, eff. 12-1-1977)
   G.   Reading Meters; Billing 2 : The water meters shall be read monthly and bills prepared and mailed on or about the first day of each month for water used to the date of reading. (Ord. 943, eff. 12-1-1977; amd. Ord. 1165, 3-18-1991)
   H.   Leak In Sewer Line; Repair By Customer:
      1.   Immediate Discontinuance For Health Hazard: If a City sewer customer has a break or leak in his sewage line or sewer system or other defects which, in the opinion of the City, is creating a health hazard, such sewage service may be immediately discontinued.
      2.   City Repair; Customer Responsible For Cost: If a City sewage customer has a break or leak in his sewage line or sewage system, the City shall have the right to repair or replace said sewage line or sewage system. If the City repairs or replaces the sewage line or sewage system of a customer which, in the opinion of the City, said sewage line or sewage system is creating a health hazard, the customer shall pay to the City the reasonable and necessary charges for repair or replacement of the said system before that customer's sewage service is restored.
